Terms and conditions — Magic Multi

1. About these Terms

These Terms and Conditions (Terms) are a binding agreement between you and Magic Multi (we, us, our), the operator of magicmulti.com (the Service). By accessing, registering for or using the Service you agree to these Terms. If you do not agree, do not use the Service.

In these Terms:

Bookmaker means a wagering service provider licensed in an Australian state or territory. At the date of these Terms the only Bookmaker the Service hands bets to is Sportsbet.
Generated Bet means any multi, Same Game Multi, Same Race Multi, selection or combination of selections produced by the Service.
Hand-off means transferring a Generated Bet, or a link to it, to a Bookmaker's bet slip or website.

These Terms should be read with our Privacy Policy, which forms part of them.

2. Magic Multi is not a bookmaker

We do not operate a wagering service, accept or place bets, hold or handle funds, pay winnings, or set or offer odds. We hold no wagering licence. Every bet is placed by you, with a Bookmaker, on that Bookmaker's platform and under that Bookmaker's terms. Our part ends at the Hand-off.

The Service is free. We do not charge fees and we never ask for payment or bank details.

3. A novelty generator, not betting advice

Generated Bets are random combinations built from the filters and presets you select. They come from filters and randomisation, not from analysis, research or opinion. Nothing on the Service is betting advice, a recommendation, or a statement about how any selection will turn out, and no Generated Bet is any more likely to succeed than a bet you could have built yourself. The "Wizard" is a brand character and a guided filter tool; it has no knowledge of outcomes.

You alone decide whether to place any bet and how much to stake, and you alone bear the outcome.

4. Odds accuracy is not guaranteed

Prices, markets, fixtures and runners shown on the Service were read from the Bookmaker at our last refresh and may be out of date by the time you see them. Prices move, markets are suspended and selections become unavailable without notice to us. The price the Bookmaker shows at the moment you confirm your bet is the price that applies — not the price shown by us. A Bookmaker may silently drop a leg that is no longer available and reprice the rest. Always check your bet slip before you confirm.

We do not guarantee that any Generated Bet can be placed, or that the Hand-off will work at all. A Bookmaker may change or withdraw the link we use at any time.

5. Responsible gambling

Gambling can be harmful. Chasing losses, betting more than you can afford, or betting to escape stress are warning signs.

The Service is designed to be quick. Treat that as a reason for more care, not less. Set your own limits before you bet, and use the deposit limits, loss limits, cool-off and self-exclusion tools your Bookmaker provides. We may limit how many bets you can generate in a period, and we may pause or refuse generation at any time.

If you tell us you want to be excluded from the Service, we will close your account and stop all marketing to you.

6. Eligibility, and your declarations are your responsibility

By using the Service you represent, on each occasion you use it, that:

you are at least 18 years of age;
you are physically located in, and ordinarily resident in, Australia;
you are not registered on BetStop, the National Self-Exclusion Register, and are not subject to any other self-exclusion, exclusion order or break arrangement with any Bookmaker;
you are not prohibited by law, court order, or the rules of any sporting body from placing wagers (including as a player, official, coach or associate of a competition you may bet on); and
your use of the Service is for personal, recreational purposes only.

When you sign up we ask two questions: whether you are 18 or over, and whether you are registered with BetStop or another self-exclusion register. These are good-faith questions. We rely on your answers. We have no access to the BetStop register or to any other, and we do not verify identity, age or residence to the standard a licensed Bookmaker must. Your Bookmaker carries out its own verification, and nothing here substitutes for it. If you answer falsely, the consequences are yours.

If you are on BetStop or have self-excluded, you must not use the Service. Free, confidential support is available at betstop.gov.au.

7. Blocking after a rejected signup is a speed bump

If you tell us at signup that you are under 18 or self-excluded, we refuse the account and keep a keyed hash of your phone number and/or device identifier, with the reason and the date, so that the same phone or device cannot simply try again. This is a best-effort measure. It is keyed on hashed identifiers that can be changed or avoided, it is not a compliance control, and it does not replace BetStop or a Bookmaker's own exclusion tools. We make no promise that it will stop a determined person. The Privacy Policy explains what is kept.

8. Your account

Some features require an account. To register you give us your first name and mobile number, answer the two questions in clause 6, and may tell us which bookmakers you already use. You sign in with a code we send to your mobile by SMS; there is no password. You must give accurate information and keep it current.

You agree that:

you will hold only one account, in your own name, and will not create an account for anyone else;
you are responsible for keeping your phone secure and for all activity under your account; and
you will tell us promptly at [email protected] if you believe your account has been accessed without your authorisation, or if you become self-excluded or otherwise ineligible under clause 6.

9. Bookmakers, Sportsbet and third-party sites

Magic Multi is not affiliated with, endorsed by, sponsored by or in any partnership with Sportsbet or any other Bookmaker. "Sportsbet" and other bookmaker names are their owners' trade marks and are used only to identify where a Generated Bet is being handed to.

When you send a Generated Bet to a Bookmaker, you leave the Service and enter a relationship governed entirely by that Bookmaker's own terms, privacy policy and responsible-gambling rules. Read them. We are not the agent of any Bookmaker, and no Bookmaker is our agent. We have no control over, and accept no responsibility for:

whether a market, selection or price is available, accepted or honoured;
the odds, limits, payouts, bonuses or promotions a Bookmaker offers or withdraws;
the settlement, voiding, cancellation or resulting of any bet;
any dispute about a deposit, withdrawal, account closure, verification or restriction; or
the conduct, solvency, security or compliance of any Bookmaker.

Any complaint about a bet or a bookmaker account belongs with the Bookmaker, and if unresolved, with the relevant state or territory regulator — not with us.

10. Affiliate and partnership arrangements

At the date of these Terms we have no affiliate, referral or commercial arrangement with any Bookmaker, and we receive nothing when you place a bet. If we enter into such an arrangement, or add support for other bookmakers, we will update these Terms and our Privacy Policy to say so and give you notice under clause 15 before the change applies to your account. Continuing to use the Service after that notice means you accept the change; if you do not, close your account under clause 13.

11. Acceptable use

You must not:

use the Service other than for your own personal, recreational use;
scrape, crawl, harvest, cache or republish odds, fixtures or other data from the Service, or use automated means (bots, scripts, headless browsers) to access it;
resell, sublicense, syndicate or commercialise the Service or its output, or present Generated Bets to others as advice for payment;
reverse engineer, decompile or attempt to derive the source code, filter logic or data sources of the Service;
interfere with the Service's security or operation, or attempt to gain unauthorised access to it or to any account;
use the Service to promote wagering to anyone under 18, or to anyone you know is self-excluded; or
use the Service in a way that breaches any law, or that could expose us to regulatory action or liability.

You may share a link to or an image of a Generated Bet, provided you keep our branding and disclaimers, do not present it as advice, and do not share it with anyone under 18.

We may investigate suspected breaches and take any action we consider appropriate, including suspending access.

12. Taking a break

Settings lets you pause your account for a set period or permanently. Once set, a break cannot be shortened or cancelled — not by you, and not by us at your request. A permanent break stays in place until you contact us, and we may decline to lift it. While a break is active you cannot generate or hand off bets and we will not send you marketing.

If gambling is causing you harm, BetStop (betstop.gov.au) excludes you from every licensed online bookmaker in Australia, which a break with us cannot do.

13. Closing your account, suspension and termination

You may delete your account at any time in Settings, or by contacting us at [email protected]. Deletion removes or de-identifies your personal details straight away; the multis generated for you are kept with no link to you, and the hashed identifiers described in clause 7 are kept. We send one SMS to confirm the deletion. The Privacy Policy has the detail.

We may suspend, restrict or terminate your access to the Service, or withdraw the Service entirely, at any time and without notice — including where we believe you have breached these Terms, where you are or may be ineligible under clause 6, or where a regulator, a Bookmaker or the law requires it.

On termination, clauses 2, 3, 4, 7, 9, 14, 16 and 18 survive. We handle any information we still hold in accordance with our Privacy Policy.

14. Intellectual property

All content on the Service — including the Magic Multi name, the Wizard character and artwork, logos, copy, design, code, preset library and filter logic — is owned by us or our licensors and protected by law. Sporting fixtures, team names, runner names and odds data remain the property of their respective owners.

We grant you a personal, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. You get no other rights. If you send us feedback, suggestions or ideas, you grant us an unrestricted, royalty-free, perpetual licence to use them without obligation to you.

15. Changes to these Terms

We may amend these Terms at any time by publishing an updated version on the Service; the "Last updated" line at the top shows when. Where a change is material, we will give reasonable notice by SMS or an on-site notice before it takes effect. Continuing to use the Service after a change takes effect means you accept the amended Terms. If you do not accept them, stop using the Service and close your account.

16. Disclaimers and limitation of liability

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, we limit it to resupplying the Service or paying the cost of resupply.

Provided as is. Subject to the paragraph above, the Service is provided "as is" and "as available". We make no warranty that it will be uninterrupted, error-free or secure, or that any data, odds or Generated Bet will be accurate, current, available or capable of being placed.

Betting losses. To the maximum extent permitted by law, we are not liable for any loss you suffer as a result of placing, or not placing, a bet — including lost stakes, lost winnings, a bet that could not be placed, a market that was suspended or repriced, a Generated Bet that was void or invalid, or any decision you made in reliance on the Service. Betting involves risk and you may lose money. You accept that risk entirely.

Excluded loss. To the maximum extent permitted by law, we are not liable for indirect, consequential, special or punitive loss, or for loss of profits, revenue, opportunity, data or goodwill, however arising.

Liability cap. To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with the Service and these Terms is limited to AUD $100.

Indemnity. You indemnify us against any claim, loss, cost or liability we incur arising from your breach of these Terms, your use of the Service, or your breach of any law or of a Bookmaker's terms — except to the extent it results from our own negligence or wilful misconduct.

17. Privacy

How we collect, use, store and disclose your personal information is set out in our Privacy Policy, which forms part of these Terms. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

18. General

Governing law. These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.

Complaints. If something goes wrong, contact us first at [email protected] with the details. We will acknowledge within 30 days and try to resolve it promptly. Complaints about a bet, a bookmaker account or a payment belong with your Bookmaker (clause 9).

Severability. If any part of these Terms is found to be unenforceable, it is severed and the rest continues to apply.

No waiver. A delay or failure by us to enforce a right is not a waiver of it.

Assignment. You may not assign your rights under these Terms. We may assign or novate ours in connection with a sale or restructure of the business.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between us about the Service and replace anything said or written before.
